OWNER AND GENERAL CONTRACT CONDITIONS
These general terms and conditions, hereinafter GCC, regulate the purchasing conditions of the different products offered on our website: www.ivamon-color.com, owned by Hiperdecoració Vilanova SL (hereinafter Ivamon Color), a Spanish company with CIF B62435730, and located at Ronda Europa nº48 Nave 1 - 08800 - Vilanova i la Geltrú (Barcelona) - Spain.
Users who make purchases at www.ivamon-color.com fully accept these GTC and will be bound by them, as if they were written at the time of contracting/purchase.
It is an essential requirement to read and accept the GTC prior to purchasing any product through www.ivamon-color.com
Pursuant to current legislation, products may be returned for any reason within a maximum period of 14 calendar days from receipt of the goods by the customer. To do so, the conditions set out in this document must be met. You can do so by completing the withdrawal form that will be delivered to you by email.
Ivamon Color reserves the right to modify the GTC at any time and without prior notice. The GTC will always be accessible from the website, so that the user can consult or print them at any time.
Placing an order by completing the purchase form implies acceptance of the price offered and the general conditions of sale in force at that specific time. Once the order has been placed, the purchase will be deemed to have been completed by full right, with all the legal guarantees that protect the purchasing consumer and, from that moment on, the prices and conditions will be contractual and may not be modified without the express agreement of both contracting parties. The electronic document in which the contract is formalised will be archived and the user will have access to it in their customer area.
SHIPPING CONDITIONS
- Delivery times range from 24 to 72 hours, depending on the customer's choice. We cannot guarantee these delivery times, although we try to ensure that transport companies comply with them whenever possible. In rural areas far from urban centres, it is not possible to guarantee delivery within 24 hours under any circumstances.
- It is not possible to determine a fixed delivery time and make a prediction of the exact time at which the delivery person will deliver the order.
- Shipping is guaranteed under the conditions chosen by the customer when placing the order, provided that it is placed before 4 p.m. and the product is in stock. After this time, one more day will be counted since the transport agency will have already collected the packages from that day.
- Delivery times will depend on the availability of each product, and there may be cases of stock shortages in the warehouse, in which case the customer will be notified of the new delivery time. For orders that include several items, a single shipment will be made and the delivery time will correspond to the item with the longest delivery time.
- The customer must review the order as soon as possible to check that everything ordered is included. If the customer is not satisfied with what they received, they must notify Ivamon Color as soon as possible. An order will be considered delivered when the delivery receipt is signed by the customer.
- If for any reason there is a delay in shipping, we will inform you of the delivery time, which will not be more than 10 days. If you do not agree with the new delivery time, you may request a refund of the full amount paid without any type of penalty.
- In the event of a defect in the order, Ivamon Color will be notified immediately via email. ecommerce@ivamon-color.com Attaching photos if possible and a description of the problem. Ivamon Color will try to correct this error as soon as possible.
- If you receive a product damaged during transport, it is advisable to contact us within the first 24 hours so that we can file a claim with the transport company. It is also advisable to notify the transport company. If you notice large damages on the package when it is delivered or paint stains, it is advisable not to accept the package and inform us of this decision as soon as possible so that we can resend your order and ensure that it arrives in perfect condition as soon as possible. If you see these damages after the delivery person has left, you must send us photos of the sealed package with the damages within the following 24 hours so that we can claim the damages from the transport agency and be able to send you your order again.
- Shipping costs are easy to calculate, just add the products to the cart and when entering the delivery address, you can choose between several shipping methods depending on the province or even country. Shipping costs depend on the total weight of the cart and the destination.
- Shipping costs will be free for orders over €100 (tax included) excluding shipping costs. This condition will only apply to any destination within mainland Spain. For other destinations, shipping costs will always apply unless otherwise agreed between the parties.
FOR SALE IN CANARY ISLANDS, CEUTA AND MELILLA
All sales made in the Canary Islands, Ceuta and Melilla are considered exports, so when a customer from these destinations completes their form and adds their address, VAT will automatically be removed from all products.
Currently, we only ship to the Canary Islands from these three destinations for logistical reasons, and the shipping cost will depend on the destination island. Shipping will be done by boat because there are many products that, due to their dangerous condition, cannot travel by plane and it will take between 10 and 15 calendar days. Shipments will be made under "T2LF Expedition without export DUA" condition as long as they meet the conditions, but upon arrival at destination, the customer assumes the additional costs that may be charged at customs such as the import DUA or the Canary Islands tax (IGIG).
Destinations to Ceuta and Melilla are not yet possible, but we are working to be able to ship to these destinations shortly.
SHIPPING METHODS
Our goods are shipped through various express and non-urgent transport agencies or through ADR transport for some of our products. Ivamon Color reserves the right to modify the type of shipment if the product cannot be sent by the indicated agency due to dangerous conditions or due to size or weight.
Ivamon Color will communicate this decision, if it is made, to the client by e-mail. Below we show the most common shipments and agencies used by Ivamon Color, but these may vary depending on the existing offer on the market.
PENINSULAR SPAIN
- Correos PAQ72 home: Delivery service within 48/72 hours to home depending on destination through the public company Correos.
- Correos PAQ72 office: Delivery service within 48/72 hours at the Post Office closest to the address provided by the customer.
- TIPSA24: 24-hour delivery service. Delivery is guaranteed before 2 p.m. the following day provided the order is confirmed before 4 p.m.
- Oversized and ADR: Delivery within 48/72 hours depending on the destination through Dachser or DB Schenker agencies, as appropriate. Includes service for dangerous goods with ADR category that cannot travel by more urgent methods.
BALEARICS
- Correos PAQ72 home: Delivery service within 48/72 hours to home depending on destination through the public company Correos.
- Correos PAQ72 office: Delivery service within 48/72 hours at the Post Office closest to the address provided by the customer.
- Oversized and ADR: Delivery within 72/96 hours depending on destination. Includes ADR category dangerous goods service that cannot travel by more urgent methods.
CANARY ISLANDS, CEUTA AND MELILLA
We currently only ship to the Canary Islands. Transport is done by boat. As soon as you register with your address in the Canary Islands, VAT will no longer be applied to the prices.
- Canary Islands Maritime: Delivery between 10 and 12 days from placing the order.
EUROPE
All shipments to any European country that is on the address list will be made by the company GLS and the transit time will be between 4 and 7 business days from the date the order is placed.
RETURNS
You have 14 days to return a product from the time you receive it at your home. To do so, you must send an email to ecommerce@ivamon-color.com with the information regarding the order, indicating the products you wish to return and the reason. We will send you the withdrawal form, which you will have to return to us completed.
Once we receive the product(s) together with the completed withdrawal form, we will refund the money according to the payment method you used:
- If you paid by card , the payment will be credited to your account within 48 to 72 hours.
- If you paid by Paypal , the payment will be made to your Paypal account.
- If you paid by bank transfer , we will ask you for an account number to make the payment. Please note that it may take up to 48 business hours for the amount to be reflected in your bank account.
The Company shall only be liable for any decrease in the value of the goods resulting from handling them other than what is necessary to establish their nature, characteristics or operation.

WARRANTIES
The rights and obligations of both the seller and the consumer with regard to the warranty are set out below:
- In the event of a defective product, the seller must proceed, as appropriate, to repair, replace, reduce the price or terminate the contract, procedures that will be free for the consumer and user.
- The seller is liable for any lack of conformity that becomes apparent within two years of delivery.
- The consumer and user must inform the seller of the lack of conformity within two months of becoming aware of it.
The warranty does not cover defects caused by incorrect use of the product and/or handling of the product other than that necessary to establish its nature, characteristics or operation.
The following are therefore excluded from the warranty:
- Misuse of the product without following the recommendations that Ivamon Color provides both on the product page and through telephone advice or those described by the manufacturer in the product itself.
- Products modified with other products or mixtures with dyes not compatible with the product.
- Damage caused by paints or other products in areas or places where they should not be applied due to the client's lack of knowledge. Whenever in doubt, a consultation should be made before applying to a surface that may be damaged.
For these purposes, Ivamon Color informs that the Revised Text of the General Law for the Defense of Consumers and Users (TRLGDCU) establishes several options to be able to exercise the right of withdrawal. Among them, it contemplates the possibility of doing so by filling out a form electronically. In order to shorten the time and so that you can make the return in a comfortable way and without delays, from Ivamon Color we advise you to make use of this option and fill out the withdrawal form that will be provided to you once you have communicated it by e-mail. ecommerce@ivamon-color.com
ORDER CANCELLATIONS
Order cancellations that involve a refund to the customer and are made by bank transfer will have a maximum period of 30 days for administrative procedures, although we try to ensure that the period does not exceed 7 days.
DISPUTE RESOLUTION
These General Conditions are governed by Spanish law. The parties agree, at their discretion, to resolve any conflicts and waive any other jurisdiction, to the courts and tribunals of the user's domicile.
